Chapter 21: GMTSS Policies and Procedures

 

The Market Malaysia Global Meeting, Training and Seminar System provides for the development of a systematic, coordinated and comprehensive business introduction, training, motivational and support system in every location where there is Market Malaysia organizational growth. The program is comprised of various types of meetings, trainings, seminars, conferences and conventions. The following are guidelines when implementing the GMTSS:


SEC.  1     PROSELYTISING

Proselytising prospects or UnFranchise Owners at any GMTSS event is strictly prohibited. Complaints with respect to this practice should be forwarded to the Country Manager of Market Malaysia and/or the Vice President of Sales. UnFranchise Owners who proselytise prospects and/or UnFranchise Owners at GMTSS events will be subject to corrective action procedures by Market Malaysia.


SEC.  2     UNFRANCHISE BUSINESS PRESENTATION

(A)    Publicly Scheduled and Conducted UnFranchise Business Presentations:

        (1)    In order to maintain UnFranchise Business Presentation status and warrant the appointment of an UnFranchise Business Presentation Coordinator there must be an average of at least 50 people (UnFranchise Owners and guests) in attendance at these meetings at least once per month.

        (2)    Only Speakers Bureau Members may present the “MPCP” section of the UnFranchise Business Presentation. The “Introduction” and “Product” sections may be presented by a Certified Executive Coordinator or higher UnFranchise Level. If there is NOT a Speakers Bureau Member available, the Country Manager of Malaysia must approve the speaker.

        (3)    The UnFranchise Business Presentation Coordinator shall use the most current company approved UnFranchise Business Presentation as provided at unfranchisetraining.com (deleting and/or rearranging is PROHIBITED). Product Displays are OPTIONAL and may only be used IF they are up-to-date (i.e. correct LABELS) and professionally represent our company-Branded product lines.

        (4)    It is recommended that two presenters be used to present the UnFranchise Business Presentation. If two speakers are used, one speaker should present the Introduction/Product segment and the second speaker should present the Marketing Plan and Close. 

        (5)    UnFranchise Business Presentations shall be scheduled and submitted to the GMTSS Online for each calendar quarter, 30 days prior to the beginning of the calendar quarter.

(B)    UnFranchise Business Presentation Content and Delivery:

       (1)    UnFranchise Business Presentation Overview: A professional UnFranchise Business Presentation meeting should be divided into two segments:

              (a)    Introduction and Product Presentation – 20 minutes (end of Partner Store section). This should be a brief overview of our company and products.

              (b)    Management Performance Compensation Plan and Close – 45 minutes (starts with trends and timing). 

       (2)    UnFranchise Business Presentation Meeting Outline:

              (a)    UnFranchise Business Presentation Coordinator welcomes UnFranchise Owners and guests to the presentation.

              (b)    UnFranchise Business Presentation Coordinator gives a professional introduction of speaker #1 who will introduce the Company, Market Malaysia Branded products and MY.SHOP.COM.

              (c)    Speaker #1 gives a professional introduction of speaker #2 (speaker #2 will do the MPCP presentation).

              (d)    Close with a slide provided by the UnFranchise Business Presentation Coordinator promoting the next scheduled UBP and/or Local Seminars.

       (3)    Attire: All presenters at an UnFranchise Business Presentation should wear business attire (suit and tie for males, suit or     professional dress for females). UnFranchise Owners and guests are business casual (no shorts or jeans).

(C)    Frequency: Minimum once per month, or more as the growth of the assigned area demands.

(D)    Ticket Price: 

       (1)    The UnFranchise Business Presentation admission is RM20 per person for UnFranchise Owners and free for guests. Only UBP meetings that are published on the GMTSS online system may charge the fee.

       (2)    No exceptions to the above-mentioned price without approval from the Vice President of Sales.

       (3)    UnFranchise Business Presentations conducted in a home or non-meeting room are free of charge to all attending.

(E)    UnFranchise Business Presentation Coordinator:

       (1)    Qualification: In order to hold the POSITION of “UnFranchise Business Presentation Coordinator” the UnFranchise Owner MUST be a Certified Executive Coordinator or higher UnFranchise Level AND have personally sponsored two Qualified UnFranchise Owners during the previous Calendar year; If a Certified Executive Coordinator or higher UnFranchise Level that meets these criteria is not available, then Market Malaysia Country Manger will address on a case-by-case basis.  

       (2)    Appointment: Each UnFranchise Business Presentation Coordinator is appointed by the Local Coordinator and approved by the Country Manager of Market Malaysia and/or the Vice President of Sales.

       (3)    Ticket Purchase Requirements:

       (4)    Duties: Each UnFranchise Business Presentation Coordinator must perform the following duties:

              (a)    Participate as a member of the Local Leadership Team, Local Association and/or Leadership Council.

              (b)    Organize, schedule, promote and manage publicly scheduled UnFranchise Business Presentations within his or her local area.

              (c)    Submit UnFranchise Business Presentations schedule to the Local Coordinator by the meeting submission date.

              (d)    Attend and promote Market Malaysia Shop Sdn. Bhd. Annual Convention and Asia-Pacific Regional Convention every year.

              (e)    Treat all lines of sponsorship equally and impartially. A UBP Coordinator must operate with the highest code of ethics.

              (f)    Assist Local Coordinators in scheduling, managing and logistics of running UnFranchise Business Presentations and Local Seminar events.

              (g)    Make no recording (audio/video of UnFranchise Business Presentations without the express written approval of the company.

              (h)    Ensure that all UnFranchise Business Presentation meetings within your respective area are conducted in accordance with approved content, policy, rules and regulations.

              (i)    Actively monitor area UnFranchise Business Presentations for conflicts and dispute resolution. (Non-resolvable conflicts or problems should be reported to the Local Coordinator or Market Malaysia Country Manager. Final resolution should be directed to the Vice President of Sales by the Local Coordinator/Country Manager of Market Malaysia.)

              (j)    Sign an UnFranchise Business Presentation Coordinator Agreement and comply with its content.

(F)    Financial: 

       (1)    Honorariums shall NOT be paid to the presenter of the “MPCP” section of the UnFranchise Business Presentation; however, presenters will be compensated from funds remaining after all expenses from the meeting have been paid. Any remaining funds (if applicable) shall be distributed as follows:

              (a)    25 percent to the UnFranchise Business Presentation Coordinator

              (b)    25 percent to the Meeting Fund

              (c)    50 percent to the Presenter of the MPCP

       (2)    UnFranchise Business Presentation Coordinators shall submit via email an Event Financial Report to the Local Coordinator, Market Malaysia Country Manager and Company GMTSS Executive within five (5) days of the meeting.

       (3)    UnFranchise Business Presentation Coordinators MUST establish a current account to deposit funds from ticket sales and pay for expenses associated with holding these meetings.

       (4)    Copies of current account statements and bank tracking statements (including documentation of each transaction) shall be submitted (via email) to the respective Local Coordinator, Market Malaysia Country Manager and Company GMTSS Executive every month. Statements MUST be submitted by the 20th of the following month (e.g., June statements are due by July 20). 

       (5)    UnFranchise Business Presentation Coordinators may only maintain a MAXIMUM balance of RM4,000 in their respective accounts. All funds over RM4,000 shall be transferred monthly by cheque or wire transfer to the General GMTSS Account. 

       (6)    The following shall be considered legitimate front-end expenses for UnFranchise Business Presentation Meetings:

              (a)    Speaker’s Parking (as applicable)

              (b)    Meeting Room

              (c)    Ticket Printing

              (d)    Name Badges

              (e)    Promotional Flyers

              (f)    Audio/Visual Rental 

       (7)    Long-term expenses shall consist of materials and equipment that eliminate rental expenses or enhance the meetings. These expenses shall be paid for from the accumulated meeting funds or Local Association Funds.

       (8)    Besides the monthly max balance, there is also a year-end close-out balance transfer to the General GMTSS Fund. At the end of the year, UBP Coordinators are expected to bring the UBP account down to RM1,200.


SEC.  3    New UnFranchise Owner Training

The New UnFranchise Owner Training is one of the three trainings that must be attended as an UnFranchise Owner. The Basic 5 and the New UnFranchise Owner Training must be completed prior to attending the Executive Coordinator Certification Training. This training is designed to ensure that the key factors necessary for success are provided to new UnFranchise Owners.

(A)   Basic 5 and New UnFranchise Owner Training Certificates: After successfully completing the New UnFranchise Owner Training, each UnFranchise Owner must have the instructor sign the New UnFranchise Owner portion of the Basic 5 and New UnFranchise Owner Certificate (can be downloaded in the UnFranchise Business Account, Downloads > Administration). It is recommended that both the UnFranchise Owner and the instructor maintain a copy of this certificate. 

(B)   Admission Cost: New UnFranchise Owner ticket price is RM40 per person. Certified Executive Coordinators may conduct New UnFranchise Owner and Basic 5 Trainings in the HOME, but they may NOT charge attendees for these trainings. None of these trainings held in the field will count as a substitute for the mandatory Corporate New UnFranchise Owner Training.

(C)   Approved Training: Attendance of a New UnFranchise Owner Training from Market Malaysia Office is required of all new UnFranchise Owners. After this initial training for qualification, it is good to attend again to further your learning. Additional trainings may be given by Certified Executive Coordinators who have personally passed the ECCT test. None of these trainings may be conducted in a public forum until the presenting UnFranchise Owner has attained the UnFranchise Level and fulfilled the requirements necessary to become a Certified Executive Coordinator, as defined by Market Malaysia. Also, in order to maintain consistency and promote duplication within the Global Meeting, Training and Seminar System, all presenters of the New UnFranchise Owner Training shall utilise only unaltered Company-approved and provided materials available from unfranchisetraining.com. Utilising these materials not only allows for the development of rising leaders in the local area by ensuring that they are presenting the New UnFranchise Owner Training information correctly, but it also promotes the process of duplication and standardisation within the Global Meeting, Training and Seminar System (GMTSS).

The corporate-sponsored NUOT is required for all UnFranchise Owners to take in order to: (i) count as being sponsored and (ii) obtain the sponsorship rights towards/for activation purposes.

If an UnFranchise Owner does not complete a NUOT within the “NUOT Grace Period,” the UnFranchise Owner’s sponsor will lose his/her sponsorship of this UnFranchise Owner. The sponsorship rights for this UnFranchise Owner may be re-activated once this UnFranchise Owner completes the NUOT at a later date. The sponsorship takes effect on the reactivation date.

New UnFranchise Owners may sponsor other new UnFranchise Owners during their “NUOT Grace Period.” This “NUOT Grace Period” shall be defined as 28 calendar days from the week ending Friday of the respective UnFranchise Owner’s “Start Date.” If the sponsoring new UnFranchise Owner does not complete the corporate-sponsored NUOT within the 28 days allowed, then sponsorship rights towards/for activation purposes and rights to commission earned will be forever forfeited. 


SEC.  4    BASIC 5 TRAINING

The Basic 5 is one of the three trainings that must be attended as an UnFranchise Owner. The Basic 5 and the New UnFranchise Owner Training must be completed prior to attending the Executive Coordinator Certification Training. This training is designed to teach the five main fundamentals that create a successful UnFranchise Business.

(A)    Basic 5 and New UnFranchise Owner Training Certificates: After successfully completing the Basic 5 Training, each UnFranchise Owner must have the instructor sign the Basic 5 Training portion of the Basic Five & New UnFranchise Owner Training Certificate (can be downloaded in the UnFranchise Business Account, Downloads > Administration). Both the UnFranchise Owner and the instructor should maintain copies of this certificate. 

(B)     Admission Cost: Speakers Bureau Members are authorized to charge a ticket price of RM40 per person. Certified Executive Coordinators may conduct New UnFranchise Owner Training and Basic 5 Trainings in the HOME, but they may NOT charge attendees for these trainings. None of these trainings held in the field will count as a substitute for the mandatory Corporate New UnFranchise Owner Training.

(C)   Approved Training: Only Certified Executive Coordinators who have personally passed the ECCT test may conduct Basic 5 Trainings. None of these trainings may be conducted in a public forum until the UnFranchise Owner has attained the UnFranchise Level and fulfilled the requirements, as defined by Market Malaysia, pertaining to being a Certified Executive Coordinator. Also, in order to maintain consistency and promote duplication within the Global Meeting, Training and Seminar System, all presenters of the Basic 5 shall utilize only company-approved and provided materials available from unfranchisetraining.com. Utilising these materials not only allows for the development of rising leaders in the local area by ensuring that they are presenting the Basic 5 information correctly, but it also promotes the process of duplication and standardisation within the Global Meeting, Training and Seminar System (GMTSS).


SEC.  5    EXECUTIVE COORDINATOR CERTIFICATION TRAINING

The Executive Coordinator Certification Training (ECCT) is one of the three trainings that each UnFranchise Owner must attend. In order to be a Certified Executive Coordinator with Market Malaysia, you must complete a New UnFranchise Owner Training, a Basic 5 Training, and attend and pass the Executive Coordinator Certification Training.

(A)    Prerequisites: UnFranchise Owners must have attended a Basic 5 Training and a New UnFranchise Owner Training, and present the Basic 5 and New UnFranchise Owner Training Completion Certificate to gain admittance to an Executive Coordinator Certification Training.

(B)    Required Attendance: Executive Coordinators must attend an Executive Coordinator Certification Training and pass a written test within 28 days of being issued an Executive Coordinator commission, or they shall forfeit subsequent commission until this requirement has been satisfied and submitted to Market Malaysia by the Certified Trainer who conducted the ECCT.

       For partnerships and married couples, it is recommended that all persons involved with the UnFranchise Ownership attend the ECCT and pass the written test. However, only one of them is required to do so for qualification. Only qualified Certified Executive Coordinators that have personally attended an ECCT and passed the written test are authorized to teach New UnFranchise Owner Training and Basic 5 Training.

(C)    Admission Cost: Because the degree of responsibility that Certified Trainers have is so large, and the Certified Trainers are such an elite group of instructors within the Market Malaysia system, it is only fair that they be compensated for their time and experience. Guidelines for pricing regarding the Executive Coordinator Certification Training are as follows:

       (1)    The pricing is per person (not per UnFranchise Business or partnership) for an Executive Coordinator Certification Training.

       (2)    For each UnFranchise Owner who wishes to attend an Executive Coordinator Certification Training, the following will apply:

              (a)   Initial ECCT attendees are those who have never attended an ECCT and passed the test. They must take the ECCT test at the end of the class. If they pass, they get an ECCT Certificate and will be considered a Certified Executive Coordinator (CEC) once the UnFranchise Level of Executive Coordinator is reached. The fee for an Initial ECCT is RM150 per person. 

              (b)    An ECCT Audit is for UnFranchise Owners that have already attended at least one ECCT and passed the test. They are attending to gain knowledge or to meet UFO or challenge requirements. The test is optional and will not count for or against the UnFranchise Owner, pass or fail. These attendees have passed the test before and are attending to update their knowledge base or fulfil UFO or Challenge requirements. The fee for an ECCT Audit is RM80 per person.

(D)    Approved Training: Only authorized and active Certified Trainers may conduct Executive Coordinator Certification Training. To obtain a list of Certified Trainers for a respective area and their location, contact Local Coordinators of Market Malaysia. An ECCT is a minimum of six hours.


SEC.  6        CERTIFIED TRAINER SCHOOLS

Certified Trainer Schools are corporate-sponsored and corporate-operated training programs conducted one to three times per year. These Certified Trainer Schools are conducted to teach qualified UnFranchise Owners how to teach other UnFranchise Owners and UnFranchise Owners the key administrative elements necessary for successful participation in the Management Performance Compensation Plan. Certified Trainers are the only approved trainers permitted to conduct the Executive Coordinator Certification Training, a mandatory requirement for all Executive Coordinators. 

(A)    Prerequisites: Candidates for Market Malaysia Certified Trainer Schools must meet all requirements below and be approved by the Director of Field Training at Market Malaysia. Those requirements are as follows:

       (1)    Must be a Qualified Executive Coordinator under the Marketing Plan.

       (2)    Must qualify as an Executive Coordinator under the Marketing Plan for three consecutive months prior to attending a Certified Trainer course and then every month thereafter to maintain Certified Trainer status (that is, earning RM12,000 in commission cheques from one Business Development Centre each and every calendar month).

       (3)    Must have qualified or requalified in the Master UFO program either one calendar quarter of the previous year or one calendar quarter of the current year before attending Certified Trainer School.

       (4)    Must requalify in the Master UFO program at least two calendar quarters of each year going forward.

       (5)    Must be a fully paid member of the Company’s UnFranchise Management System and must have executed a UFMS Agreement.

       (6)    Must own a current Company UnFranchise Manual and must have read and fully understand the UnFranchise Manual and be familiar with its contents in order to reference it at any time for specific answers to questions on the Marketing Plan, policies and procedures, rules and regulations, administration of forms, and business-building or merchandising techniques.

       (7)    Attending this school does not guarantee that the Candidate will be a Certified Trainer. The Candidate must have a knowledgeable understanding of the Marketing Plan, Basic 5, and UnFranchise Manual, and must pass the Certified Trainer Examination with a score of at least 90 percent.

       (8)    Will attend and complete the two- to three-day Certified Trainer School at Market Malaysia Office or at such other location as is designated by the Company and meet all requirements set forth by the School Trainer and/or Director for successful completion and graduation from the school. This includes, but is not limited to: the completion and filing of a comment sheet, participation in all required activities, successfully passing any written or oral test, and being certified by the School Trainer or Director.

       (9)    Will pay in full to the Company the full cost of tuition for the Certified Trainer School prior to attending (This tuition is non-refundable).

       (10)    Will maintain the ongoing requirements as specified by the Market Malaysia. Certified Trainer Agreement.

(B)       Reapplication: If an applicant for Certified Trainer School is accepted but decides not to attend due to personal reasons or other circumstances, then the applicant must reapply and go through the requalification process for the next school if he/she still desires to become a Certified Trainer.


SEC.  7    MOTIVES TRAININGS 

There are two (2) types of Motives training courses and complimentary workshops. If a Motives Certified Trainer is in good standing, the Motives Certified Trainer may conduct the following Motives Training classes:

NOTE: Only Motives Certified Trainers are authorized to charge a fee for Motives trainings and workshops.

(A)    Motives 1 to 1 Training: Trainer will give a tour of our collection as well as in depth education on how to create life-long relationships by offering customized solutions to clients. Trainer will dig deep into the importance of proper sanitation of your cosmetic kit and offer you all the tools you'll need to conduct effective and efficient Client Consultations. After mastering the 1 to 1, the Trainer move on to the leverage behind having a fun and interactive event with your clientele and even offer an action plan to set you up for success moving forward! Ticket price is RM110. 

       (1)    Motives Marketing Workshop: This workshop is focused on providing a lively discussion on the Beauty Industry, paired with viable solutions you can offer as a Beauty Advisor. We'll chat about the uniqueness of our brand and how you can position yourself to evolve into a professional by leveraging the tools, education and ongoing support available to our Motives community. Ticket price is RM60.

       (2)    The Art of Makeup - Guided Application: This workshop is designed to help guide you - step by step - through proper technique and using products that will help keep your makeup lasting all day long and looking fresh! Ticket price is RM60.

(B)    Skincare 1 to 1 Training: Trainer will begin with a description of industry statistics and consumer demand. Trainer will then differentiate our brands so that you understand the uniqueness of our exclusively branded products. Attendees will have a chance to interact with one another and practice ‘Conducting a Consultation’ with questions guided by the trainer. There will be a live demonstration of how to conduct an ‘All About Skin’ event, which is a systemized, duplicatable retail event with a written guidelines and included marketing / sales materials. Lastly trainer will discuss income possibilities based on building share of customer, being a product of the product and embracing the Shopping Annuity. Ticket price is RM110.

       (1)    Advanced Skin Solutions Workshop: During this workshop trainer will recap Skin Types but dig deeper into servicing clients by understanding their skin’s needs and discussing product and lifestyle options to offer as a solution. Trainer will also focus on Beauty from the Inside Out. Ticket price is RM60.

       Only Certified Motives® Trainers are authorized to charge a ticket price for Motives meetings which are published on the GMTSS online system. 


SEC. 16       MOTIVES PROFESSIONALS

Market Malaysia has defined two (2) levels of Motives Professionals

(A)     Motives Certified Beauty Advisor: UnFranchise Owners must meet the following requirements in order to become a Motives Certified Beauty Advisor:

       (1)    UnFranchise Owners must have attended the following classes:

              (a)    Skincare 1 to 1 Training

              (b)    Advanced Skin Solutions Workshop

              (c)    Motives 1 to 1 Training

              (d)    Motives Marketing Workshop

              (e)    Art of Makeup – Guided Application Workshop

       (2)     Purchase all products needed to successfully host and conduct an All About Skin and It’s Your Time to Shine retail events. 

       (3)     UnFranchise Owners who wish to become a Motives Certified Beauty Advisor are encouraged to utilize the Motives Welcome Guide.

(B)    Motives Certified Trainer: Motives Certified Trainer Initial Qualification Requirements — UnFranchise Owners must meet the following requirements in order to become a Motives Certified Trainer and submit an application to the Motives department for review:

       (1)    Must have met the requirements for a Motives Certified Beauty Advisor. 

       (2)    Purchase all of the products needed to showcase during each respective course.

              (a)    Motives 1 to 1 

                     (i)    The full range of current foundation shades

                     (ii)    Necessary tools and products to prep skin for makeup application

                     (iii)    A Collection of top selling and personal favorite Motives products

                     (iv)    All of the products needed to successfully host and conduct a Beauty Basics, and
                             It's Your Time to Shine retail event 

                     (v)    Any current seasonal products/palettes to showcase

                     (vi)    Marketing Materials to support the retailing / business building process (i.e. Motives
                             Welcome Guide, Product Flyers, Consultation Guideline, Hostess Incentive Packet,
                             etc.)

              (b)    Skincare 1 to 1

                     (i)    Comprehensive Skincare Collections (such as Lumiere de Vie full Regimen) as well as uniquely branded specialty care products

                     (ii)    All of the products needed to successfully host and conduct an All About Skin Retail Event

                     (iii)    Marketing Materials to support the retailing / business building process (i.e. Motives Welcome Guide, Product Flyers, Consultation Guideline, Hostess Incentive Packet, etc.)

                     (iv)    A collection of Personal Care products to showcase to the class

                     (v)    Home Shopping List & MA Catalog to help the class understand how to convert their spending into earning and fund their Shopping Annuity. 

       (3)    Must be at least an Executive Coordinator. 

       (4)    Must earn at least RM3,600 in commission income and 600 BV per calendar quarter, of which at least 200BV must be Motives and 400BV in skincare and personal care.

       (5)    Must be a Shopping Annuity Master Member;

       (6)    Must personally sponsor two (2) qualified UnFranchise Owners in the previous calendar year and

       (7)    Must purchase three (3) Market Malaysia Annual Convention and Market Malaysia Leadership School tickets per year. 

(C)    Ongoing Motives Certified Trainer Requirements: Once an UnFranchise Owner becomes Motives Certified Trainer, the UnFranchise Owner must continue to meet all of the initial requirements, in addition to the following:   

       (1)    Purchase all new products launched at Annual Convention and Leadership School 

       (2)    Attend monthly Motives Certified Trainer meetings 

       (3)    Must attempt each Motives Challenge and achieve at a minimum all asterisk tasks and activities and email your paperwork to Motives Department even if you have not achieved the challenge 

       (4)    Must conduct one of each of the Motives Trainings and Workshops per quarter (through GMTSS) which include:

              (a)    Skincare 1 to 1

              (b)    Advanced Skin Solutions

              (c)    Motives 1 to 1

              (d)    Motives Marketing

              (e)    Art of Makeup – Guided Application

       (5)    Must conduct at least three (3) Motives Events of your choice per quarter (in accordance with the Motives Welcome Guide) such as:

              (a)    Motives Beauty Basics Event;

              (b)    Motives It’s Your Time to Shine;

              (c)    All About Skin Event; 

       (6)    Recertify every two (2) years


SEC. 9        LOCAL SEMINARS

A Local Seminar is a more in-depth Basic 5 presentation that lasts at least six hours and features a Guest Speaker who is an approved Speakers Bureau Member. Local Seminars are governed by the following guidelines: 

(A)    Publicly Scheduled and Conducted Local Seminars:

       (1)    In order to maintain “Local Seminar” status and warrant the appointment of a Local Coordinator, there must be at least two (separate geographic locations) publicly scheduled UnFranchise Business Presentation Meetings at least once per month (each) in the GMTSS Online for the immediate geographic area AND at least 150 tickets must be sold for each such Local Seminar event (any exception must be approved by the Vice President of Sales).

       (2)    All Local Coordinators shall schedule and submit Local Seminar event dates to the GMTSS online for each calendar quarter 30 days prior to the quarter. Local Coordinators shall consult with the Country Manager of Market Malaysia prior to scheduling.

       (3)    Only Category 2 Speakers Bureau members are eligible to be booked to speak or train at a Local Seminar in accordance with the honorarium guidelines listed on the Market Malaysia Speakers Bureau Section.

       (4)    There shall be no cap/limit to the number of tickets that may be sold for a Local Seminar, provided an appropriate facility can be secured.

       (5)    Local Seminar agendas shall consist of > 5.5 hours of training time and .5 hours (30 minutes) of recognition. 

(B)    Frequency: Local Coordinators must schedule at least two (2) and no more than seven (7) Local Seminars in a calendar year.

(C)    Ticket Price: RM100

(D)    Local Coordinator:

        (1)    Qualification: In order to hold the position of “Local Coordinator,” the individual MUST be a Senior Master Coordinator or higher UnFranchise Level, Speakers Bureau Member AND have personally sponsored two Qualified UnFranchise Owners during the previous calendar year. If a Senior Master Coordinator or higher that meets these criteria is not available, then the Country Manager of Market Malaysia will address on a case-by-case basis. 

       (2)    Appointment: The Country Manager of Market Malaysia recommends individuals to be Local Coordinators. The final appointment of Local Coordinators is made by the Vice President of Sales.

       (3)    Ticket Purchase Requirements:

       (4)    Duties: Each Local Coordinator must perform the following duties:

              (a)    Lead the local Leadership Team/Council and Local Association.

              (b)    Organize, schedule, promote and manage Local Seminars and publicly scheduled UnFranchise Business Presentations within his or her assigned area.

              (c)    Recommend UnFranchise Business Presentation Coordinators in appropriate areas of growth within their respective locales; ensure that UnFranchise Business Presentation Coordinators are conducting meetings within the guidelines and in accordance with Company’s policies and procedures as defined in the most current/updated version.

              (d)    “Specialized” (Motives, TLS, Product Trainings, etc.) UnFranchise Business Presentations MUST be organized, scheduled and approved by the appropriate Local Coordinator and Country Manager of Market Malaysia to ensure there are no schedule conflicts.

              (e)    Submit Local Seminar schedules on the GMTSS online system for approval by the Country Manager of Market Malaysia, and/or the Vice President of Sales.

              (f)    Attend the Market Malaysia Asia-Pacific Regional Convention and Market Malaysia Annual Convention per year. 

              (g)    Coordinate scheduling and promotion of UnFranchise Business Presentation Meetings within his or her local area.

              (h)    Promote Company’s corporate-sponsored Annual Convention and Asia-Pacific Regional Convention.

              (i)    Treat all lines of sponsorship equally and impartially. 

              (j)    Comply with guidance by the Vice President of Sales.

              (k)    Sign a Local Coordinator Agreement and comply with its content.

       (5)    General Requirements: Each Local Coordinator must meet the following general requirements: 

              (a)    Ensure that Local Seminar events are conducted in accordance with meeting room setup, mechanics and format as set forth in the GMTSS events guide.

              (b)    Ensure that all UnFranchise Business Presentations within his or her area are conducted in accordance with approved content, policy, procedure, rules and regulations.

              (c)    Ensure that all Basic Five trainings and Executive Coordinator Certification trainings within your area are conducted in accordance with approved content, policy, procedure, rules and regulations.

              (d)    Submit Local Seminar event information to the Country Manager at least thirty (30) days prior to the event for approval.

              (e)    Make no recordings (audio/video) of any event without the express written approval of the Vice President of Training and Field Development.

              (f)    Submit speakers and associated honoraria to Company for approval 30 days prior to the event.

              (g)    Sell a minimum of 150 Local Seminar tickets.     

              (h)    Pre-purchase 10 tickets directly from Company for Asia-Pacific Regional Convention (five of these can be purchased with the Local Association Funds, to be reimbursed when the tickets are sold; and five of these are from personal funds), and 10 tickets directly from Company for Annual Convention (five of these can be purchased with the Local Association Fund, to be reimbursed when the tickets are sold; and five of these are from personal funds).    

              (i)    Randomly monitor meetings and trainings in his or her area for compliance with policies and procedures as defined by Company. Actively monitor local area for conflicts and dispute resolution. (Non-resolvable conflicts or problems should be reported to the Country Manager of Market Malaysia. Final resolution should be requested from the Vice President of Sales.)

              (j)    Promote and sell tickets to all area meetings, training, seminars, conferences, conventions and corporate sponsored events.

(E)    Financial: 

       (1)    Each Local Coordinator shall submit (scanned email) an Event Financial Report (form will be supplied by the Company to all Coordinators).

       (2)    Each Local Coordinator shall establish a separate checking account requiring two signatures to deposit funds from ticket sales and pay expenses associated with Local Seminars. All credits (deposits) and debits (expenses) MUST be documented describing each transaction.

       (3)    After ALL front-end expenses associated with the Local Seminar have been paid, the remaining funds shall be distributed as follows:

              (a)    40 percent to the Local Coordinator

              (b)    45 percent to the Local Association Event Fund

              (c)    15 percent to the Featured Speaker (within two weeks after event)

       (4)    The following shall be considered legitimate front-end expenses for Local Seminars:

              (a)    Speaker honorarium (in accordance with guidelines and sent two (2) weeks prior to event date)

              (b)    Speaker travel such as airfare/mileage (spouse, if training or ticket sales can support)

              (c)    Speaker hotel accommodations (night prior to and night of the Local Seminar)

              (d)    Speaker meals (includes Local Coordinator and “shadow” meals; shadow and spouses as applicable)

              (e)    Speaker gift basket/snacks (< RM200)

              (f)    Speaker gift (< RM400; tasteful)

              (g)    Speaker pin money for travel for meals, parking, taxis to and from departing airport (< RM800 with honorarium)

              (h)    Seminar room (must disclose if room rate was negotiated in exchange for meals, room rentals, etc.)

              (i)    Seminar room setup (minimal)

              (j)    Audio/visual rental (if applicable, that Local Association does not own)

              (k)    Badges/wrist bands

              (l)    Insurance

              (m)    Audio/visual engineer (< RM1,000, if not included in rental)

              (n)    Tickets, promo flyers

              (o)    Speaker’s needs (such as photocopies, water, etc.)

       (5)    The following shall be considered legitimate back-end expenses for Local Seminars and MUST be paid for out of the Local Association’s 30 percent distribution as applicable:

              (a)    Giveaways/on-time drawings (< RM600)

              (b)    Awards (< RM400)

              (c)    Receptions for Challenge Winners (< RM800)

              (d)    Leadership Council dinner after seminar (< RM1,600)

              (e)    Photographer (minimal)

              (f)    Merchant account charges

       (6)    The following shall be considered legitimate long-term expenses/use of Local Association funds in checking account or an account in the Regional General GMTSS Account:

              (a)    Bank/accounting expenses

              (b)    Purchase of audio/video equipment (as decided by Leadership Council and approved by Country Manager of Market Malaysia)

              (c)    Travel/lodging/meal expenses for any required meetings as directed by Market Malaysia.

              (d)    Ongoing merchant account expenses

       (7)    Each Local Coordinator must submit (scanned email) copies of Local Association current account statements (including documentation describing each transaction) to the respective Regional Director and Corporate GMTSS Executive every month. Statements for any given month MUST be submitted by the 20th of the following month (e.g., June statements are due by July 20). 

       (8)    Local Coordinators may only maintain a MAXIMUM balance of RM12,000 (RM4,000 additional if UnFranchise Business Presentation Coordinators are using same account per Coordinator) in their Local Association’s account. ALL funds in excess of the RM12,000 (RM4000 per UBP Coordinator additional) shall be transferred to the General GMTSS Account. Be responsible with Local Leadership Team/Council and Local Association, for guaranteeing and covering all deficits resulting from Local Seminar events.

       (9)    Besides the monthly maximum balance, there is also a year-end close-out balance transfer to the General GMTSS Fund. At the end of the year, Local Coordinators are expected to bring the Local account down to RM2,000 (aside from ticket money for January event).

       (10)    Unpaid financial obligations that are not settled in a timely manner and are brought to the attention of Company may be deducted from Local Coordinator’s commissions and leadership bonuses for payment to the applicable parties.

       (11)    Provide sales aids and business building tools for UnFranchise Owner purchase at Local Seminar events (maintenance of RM800 inventory required).

       (12)    Cover expenses of invited Corporate Team members and/or guest speakers (i.e. honoraria, airfare, mileage, car rental, hotel, meals and travel expenses). Honoraria must be paid not less than two weeks prior to the event. Honoraria for Corporate Team members must be directed to the Vice President of Sales.

       (13)    In the event that there are two featured or guest speakers, the extra money allocated to the speakers from above shall be divided equally between the two speakers. There should never be more than two featured speakers, including a Corporate Team member, for any given GMTSS event. Any exceptions must be approved in writing by the Vice President of Sales. This percentage is in addition to the speakers required honorarium which is determined by the Speaker’s UnFranchise Level and/or Corporate position. Honorarium for Corporate Team members shall be determined by the Vice President of Sales.


SEC.  10    MARKET MALAYSIA’S APPROVED SPEAKERS BUREAU PROGRAM

Speaking at an approved Market Malaysia or Global Meeting, Training and Seminar System event is a privilege conferred by Market Malaysia. Only members of Market Malaysia’s Speakers Bureau Category 2 are authorized to be Guest/Featured Speakers at Market Malaysia Local Seminars. It is imperative that we protect the integrity of the system as well as the quality of information shared at such events.

(A)    Speakers Bureau is divided into two categories of speakers/trainers. The following describes the types of trainings each category may perform/conduct and the associated criteria that must be met in order for speaker/trainer to be eligible to conduct the respective type of training.

       (1)    Category 1: These speakers/trainers may present the Management Performance Compensation Plan segment at an UnFranchise Business Presentation and conduct Basic 5 (B5) Trainings at a publicly scheduled meeting/training where attendees are charged an admission fee. 

              (a)    These speakers/trainers may present the Management Performance Compensation Plan segment at an UnFranchise Business Presentation. 

              (b)    May conduct GMTSS approved Basic Five (B5) Trainings at a publicly scheduled training where attendees are charged an admission fee.  

              (c)    Speakers/trainers MUST earn > RM6,000 each Calendar Quarter in COMMISSIONS from one (1) or more BDCs in order to remain eligible to speak/train at these GMTSS Events. 

              (d)    In addition, the speakers/trainers shall be required to personally sponsor two (2) Qualified UnFranchise Owners during the previous calendar year in order to retain eligibility to speak/train.

       (2)    Category 2: These speakers/trainers may present the Management Performance Compensation Plan segment at an UnFranchise Business Presentation, conduct a B5, and speak/train at all other GMTSS events (i.e., Local Seminar) where attendees are charged an admission fee. 

              (a)    The speakers/trainers may present the Management Performance Compensation Plan segment at an UnFranchise Business Presentation, conduct a B5, and speak/train at all other GMTSS events (i.e., Local, District, Regional) where attendees are charged an admission fee.  

              (b)    Speakers/trainers MUST be a Professional Coordinator or higher UnFranchise Level AND MUST earn > RM18,000 each Calendar Quarter in COMMISSIONS from one (1) or more BDCs to remain eligible to speak/train at these GMTSS events. 

              (c)    In addition, the speakers/trainers shall be required to personally sponsor three (3) Qualified UnFranchise Owners during the previous calendar year in order to retain eligibility to speak/train.

(B)    General Requirements:

       (1)    Speakers Bureau Members are required to be ACTIVE members in good standing (i.e., abiding by all policies established by their Local GMTSS Association including, but not limited to, pre-purchase ticket requirements). 

       (2)    Must be an actively participating member of a Local Association (Leadership Council, or GMTSS Coordinator) in his or her region.

       (3)    Be an UnFranchise Owner in good standing; have no judgements pending by the Corrective Action Board or the Dispute Resolution Board.

       (4)    Have achieved an UnFranchise Level of Certified Executive Coordinator or higher. Must have some speaking experience. 

       (5)    Must be approved by the Vice President of Sales.

       (6)    Attend the Annual Convention and Asia-Pacific Regional Convention annually. Speakers Bureau members must purchase minimum of five (5) tickets for each of the corporate-sponsored events: five (5) tickets purchased from Company for the Asia-Pacific Regional Convention and five (5) tickets for the Annual Convention. This will be reviewed after each major event.

       (7)    As a Speakers Bureau Member, you represent the Company’s finest UnFranchise Owners. You must be irreproachable, above question, and never make disparaging statements concerning the Company, the Management Team, UnFranchise Owners or fellow teammates at such events. Your approval is based upon your performance in the business and as a public speaker, your integrity, and proven loyalty to Company and to what it represents. Take this privilege seriously and be responsible in what you say, realising that you can change people’s lives. Failure to meet this qualification will result in immediate termination of this speaking contract.

       (8)    The key purpose of the GMTSS events is to support and assist attendees in building the business, earn bigger commissions and more management bonuses. 

(C)    Only Speakers Bureau Members shall be eligible to speak/train at publicly scheduled GMTSS events in which an admission fee is charged for attendance.

       (1)    B5 Trainings to be conducted in a HOME MUST be scheduled in the GMTSS Online web service AND be OPEN to the public (ALL UnFranchise Owners) in order to charge attendees for the training. ONLY Speakers Bureau Members may charge attendees for these trainings. Certified Executive Coordinators may still conduct NUOT and B5 Trainings in the HOME; however, they may NOT charge attendees for these trainings.

       (2)    Only Speakers Bureau Members may present the MPCP section of a publicly scheduled (i.e., in “GMTSS Online”) UnFranchise Business Presentation Meeting in which an admission fee is charged for attendance.

       (3)    Only Category 2 Speakers Bureau Members may speak/train at Local Seminars, District Conferences and Regional Conventions.

       (4)    To speak and be paid (Product Training, Basic 5 Training, New UnFranchise Owner Training, UnFranchise Business Presentation, and Local Seminar) in a country outside your “Home Country” (where you started your UnFranchise Business), you must be Speakers Bureau Category 2 in your Home Country and be activated in and/or earning commissions based on volume generated in the country in which you wish to speak.

       NOTE: Certified Trainers, TLS Trainers, Product Trainers, CAD Trainers, Motives Trainers, ISM Trainers and University Major Overview Trainers shall comply with training requirements as currently set forth in these respective programs.

(D)    Honoraria:

         (1)   After all front-end expenses associated with financing the Local Seminar (includes; but is not limited to Speakers Honoraria), the remaining funds shall be distributed as follows:

              (a)   40 percent (40%) to the Local Coordinator

              (b)   45 percent (45%) to the Local Association 

              (c)   15 percent (15%) to the Featured Speaker

       (2)    All Speakers Bureau members/trainers are required to submit a GMTSS Event Financial Report (EFR) within five days after each training to the respective GMTSS Executives, Local Coordinators and Regional Directors if the training location is more than a one-hour drive from the home address of the trainers. Handling of financial requirements is subject to audit. In case there is no Regional Directors, please send the EFR to the Country Managers. 

       (3)    If there are two guest speakers, then the 45-percent (45%) share allotted toward the speaker will be divided equally between the two speakers.

       NOTE: There cannot be more than two speakers per GMTSS event unless you have received written permission directly from the Vice President of Sales.


SEC.  11    MARKET MALAYSIA RESPONSIBILITIES

Market Malaysia shall ensure all activities and requirements are executed as set forth in this section and/or as set forth according to the respective agreements. 

(A)    Market Malaysia Annual Convention: Market Malaysia will hold a Market Malaysia Annual Convention annually.

(B)   Certified Trainer Schools: Market Malaysia sponsors Certified Trainer Schools and ensures that these schools are conducted at the Market Malaysia Office or as designated by the Director of Field Training at Market Malaysia.

       (1)       Market Malaysia will ensure all required documentation received from Certified Trainers is filed and/or entered into the appropriate database.

       (2)        Market Malaysia will ensure all Certified Trainer and candidate Certified Trainer qualifications are satisfied.

(C)    Motives Certified Trainer Schools: Market Malaysia sponsors Motives Certified Trainer Schools and ensures that these schools are conducted at least once annually at Market Malaysia Office or as designated by the Director of Field Development and Training for Motives at Market Malaysia.

       (1)     Market Malaysia will ensure all required documentation received from Motives Certified Trainers is filed and/or entered into the appropriate database.

       (2)     Market Malaysia will ensure all Motives Certified Trainer and candidate Motives Certified Trainer qualifications are satisfied.

(D)      Handouts and Materials: Market Malaysia will provide knowledge, information and manufacturer support materials (as practicable) to convention and seminar coordinators, and/or offer business support materials in the product order catalogue. All other business support materials are strictly prohibited. All handouts, flyers, challenges and tickets must be approved by the Director of the GMTSS at least 30 days prior to use or distribution.


SEC.  12    CERTIFIED TRAINER RESPONSIBILITIES

Certified Trainers shall comply with all terms, conditions, policies and procedures set forth in the Certified Trainer Agreement, Market Malaysia’s UnFranchise Manual, and as determined by the Director of Field Training.

(A)   Certified Trainer Schedule Requirements: Certified Trainers shall schedule at least one Executive Coordinator Certification Training, one Basic 5 Training, and one New UnFranchise Owner Training per quarter. Only events submitted via GMTSS online will be accepted. 

(B)   Event Promotions: Certified Trainers shall promote the Market Malaysia Convention and Leadership School and their respective local seminars through the pre-purchase of tickets. The pre-purchase requirements are specified on the Certified Trainer Agreement form.

(C)   Executive Coordinator Certification Training (ECCT): Upon conducting an Executive Coordinator Certification Training, Certified Trainers shall submit to Market Malaysia within five business days of the completion of the training: (1) the class attendance sheet(s); and (2) the ECCT Test Answer Sheets. This documentation must be submitted to Market Malaysia by the Certified Trainer in order to be recorded in the computer data system for the attending UnFranchise Owners.
